Mobi Mani is designed to allow you to send as much as you want. At the moment, in order to comply with the regulatory bodies, the most a Mobi Mani user can send in a seven-day period is 200,000 vatu.

When someone sends you money via Mobi Mani, you get an sms telling you that you have been paid. As soon as you get that message, you can send some or all of that money to anyone else in Vanuatu.

Mobi Mani is safer than your wallet or purse. You can key-pad lock your phone so that if it lost or stolen, no one can use your phone or access your Mobi Mani account. You can not do that with your wallet or purse. Also, if your phone is lost or stolen you can suspend your Mobi Mani account from any phone with a simple text message to Mobi Mani.

The cash value of your Mobi Mani is always held in trust in the Mobi Mani bank account in line with the legal requirements under Vanuatu law.

Mobi Mani does not have the authority to reverse a payment.  If you make a mistake, you can use the refund feature or contact the recipient directly.

If you send the wrong amount to someone or send the right amount to the wrong person, you can use the Mobi Mani refund request feature to ask the recipient to send the money back.


To request a refund, send d*number*amount to 7766555 where number is the number of the person that you sent the money to.   You can only request a refund within an hour of the time that you sent the original payment.  A refund request sent after one hour will not be honoured.


Mobi Mani will send the recipient a refund request asking them to approve or decline the refund.  To approve a refund, the recipient must reply with yes*amount.  To decline the refund, the recipient must reply with no*amount.


If the recipient approves the refund, the funds will be transferred back into your account.  The original transaction fee will not be returned and a refund fee of 50 vatu will be deducted from the refunded amount.


If the recipient declines the refund, Mobi Mani will send you an sms saying that the refund request was not successful.


 


If the recipient declines the refund, you can still contact them directly; however, Mobi Mani will have no involvement in the discussion.

Mobi Mani has a passcode feature to try to prevent people sending money to the wrong number. You can choose a passcode for your account. When someone sends you money, tell them the passcode and have them include it in the payment message (e.g. number*amount*amount*passcode). Mobi Mani will check that the passcode matches the account before the transaction is completed.

You will be able to top-up any pre-paid mobile using your Mobi Mani account. It does not matter what network (TVL or Digicel) you or the recipient is with. To top-up a pre-paid mobile account, send an sms like this to Mobi Mani:

When Mobi Mani receives the sms, Mobi Mani will take the funds from your Mobi Mani account and deposit them in the TVL or Digicel Top-Up account. Mobi Mani will then automatically send a top-up message to Digicel or TVL and the top-up will be delivered to the phone.

If you send the wrong message to Mobi Mani, we will reply with an error message, but we can only do this a few times before it becomes too costly. Therefore, we have limitiers on how often Mobi Mani will reply to incorrect messages. If you reach the limit, Mobi Mai will not send you a reply to that type of sms for 24 hours. The other features of Mobi Mani will continue to work, though.

You can choose to have the sms from Mobi Mani sent to you in English, French, or Bislama. To change the language, send an sms with l*en or l*fr or l*bl to 7766555. All sms to Mobi Mani use English words only.

Instead of typing your number in the payment sms, people who are sending you money can just type your shortcode. It is easier to remember and a bit flash. People can still use your phone number to send you money.

QuickPay allows you to send money from your Mobi Mani account to any mobile phone in Vanuatu from the Mobi Mani website.  Not only is this quick and easy, but it is cheaper because you don\'t have to send an sms to Mobi Mani.

Start by entering your mobile number in the account number box.  If this is your first time logging in to your Mobi Mani account from the website, Mobi Mani will ask you to enter your secret word (you will have added this to your account earleir from your mobile phone).  If the secret word matches te secret word in your account, Mobi Mani will ask you to add a web password.  Once you have done this, you will be logged in to your account.  Here you can view your account settings, account balance, and transaction history.

Yes, you can, if you are an agent.  Fill out the NBV deposit slip for a deposit to the Mobi Mani account.  The account number is 0125270001.  In the space where it says \"For credit of\" write your mobile number.  Give this form and the money to the teller and they will enter it into the computer system and give you a receipt (keep the receipt!!).  Now send an sms to Mobi Mani with your number*amount*amount.  When Mobi Mani receives that sms, it will check the bank account to see if the money has been deposited.  When the deposit is confirmed, Mobi Mani will transfer that amount to your Mobi Mani account and send you an sms.

Using the website features


Log-in-----you must first have set up a Mobi Mani account from your phone and have entered your secret word. On the log-in page of the Mobi Mani website, enter your phone number. If this is your first time logging onto you account from the website, you will be asked to enter you secret word. If the secret work you entered matches the secret word in your account, then you will be asked to enter your web password.


If you have logged into your account before, you will be asked to enter your web password.


QuickPay-----You can make Mobi Mani payments from the website without having to log-in to your account. Simply fill out the QuickPay form on the website. Tick the sms confirmation box if you want to receive an sms confirmation that the transaction has gone through. You can even send a brief message with the payment. Best of all, with QuickPay, you don\\\'t have to pay for the sms from your phone to Mobi Mani.


Pre-paid Top-up-----You can top-up any pre-paid mobile (Digicel or TVL) from the Mobi Mani website.  Just fill out the top-up form and click submit.  The pre-paid credit will be delivered straight to the phone.

Introduction


Welcome to Mobi Mani, a mobile phone based transaction service that allows users to send money to any mobile phone in Vanuatu using only short message service (SMS). The Mobi Mani Terms and Conditions document governs the use of the Mobi Mani transaction system available through any mobile phone in Vanuatu.


The Mobi Mani Terms and Conditions document is revised from time to time and may include changes from earlier versions. By accessing your account and using the service, you agree to the most recent version of this agreement which can be viewed at the Mobi Mani offices in Port Vila, Vanuatu or may be requested from an agent. You may withdraw your consent at any time by discontinuing the use of the Mobi Mani service.


Your account


Your Mobi Mani account is based on your mobile phone number. All access to your account is through your mobile phone, and all user account information is available to you via your phone.Mobi Mani will not allow you to access your account via the Mobi Mani computer.


If you lose your number, and cannot have it re-issued by the telephone carrier, then you will not be able to access your Mobi Mani account.


Your responsibility


You agree to use the Mobi Mani service for lawful purposes only.


You are responsible for and must provide the telephone devices necessary to access the service.


You must protect your phone from unauthorised use and not disclose your secretword to anyone.


Protecting your account and secret word


You are responsible for keeping your secret word confidential. You are also responsible for ensuring that unauthorised persons cannot use your phone to access your Mobi Mani account.


If you give your phone and your secret word to another person, you agree that that person will be acting as your agent and on your behalf and will be bound by this agreement.


Privacy


Protecting your privacy is important. Mobi Mani will never provide information about an account to a second or third party, unless required to by law.


Mobi Mani uses the last four digits of your phone number to identify you to other users (when you send money) and in transaction inquires. Mobi Mani will not disclose the entire number.


All account activity on the Mobi Mani system is recorded and archived for audit purposes.


Consent to receive sms


By accessing the MobiMani service now or in the future, you are expressly consenting to receiving communications, including but not limited to pre-recorded or artificial voice message calls, text messages, and calls from Mobi Mani and our affiliates and agents regardless of the purpose of the communication.


Fees and charges


There may be fees and charges for using the Mobi Mani service. The fees are described in Appendix A of the Mobi Mani Terms and Conditions document. Fees and charges may be changed at any time at our sole discretion. You agree to pay all fees and charges associated with the Mobi Mani service and authorise us to deduct the calculated amounts from yourMobi Mani account.


Some optional features attract a fee which is deducted from your account. These features and the associated fees are listed in Appendix A. Mobi Mani reserves the right to change the fees from time to time and without prior notification.


Mobi Mani Funds


You can put funds onto the Mobi Mani system by giving money to the Master Account, Agents, other users, or by over-the-counter deposit or online transfer into the Mobi Mani bank account. Money given to the Master Account or a Mobi Mani agent will be transferred to your account at the time of the transfer. Money deposited by over-the-counter deposit or by electronic transfer will be transferred to your Mobi Mani account as soon as the deposit is confirmed.


The funds in your account will always be backed up by an equivalent amount of cash in a trust account with an independent trustee. Fees and charges generated by account activity will be paid from the trust account to the working account on a daily basis.


Mobi Mani will not pay out cash, unless required to by law. You are able to exchange your Mobi Mani funds for cash with other users, if you so desire.


Using Mobi Mani Standard features Transactions


All transactions are final. Mobi Mani will not reverse a transaction or change the database in any fashion.


Errors


If you send money to the wrong number by mistake, Mobi Mani cannot reverse that transaction. You can contact the number that you sent it to and ask them to send it back. You can use the passcode function to minimise the chance of a mistake.


Thresholds


In order to comply with AML/CFT guidelines, Mobi Mani is required to put a limit on the amount of funds that can be transferred to or from an account in a given amount of time. If you exceed these thresholds, you will not be permitted to make further transactions until the inactivation window has expired. Thresholds are listed in Appendix B. The threshold amounts, time frames, and inactivation windows can be changed at any time without notice.


Insufficient funds


You must have sufficient finds in your account to cover the transactions and the corresponding fees and charges associated with the transaction. If you do not have enough funds in your account, the transaction will be cancelled.


Pending accounts


If you are sent money and do not have a Mobi Mani account, the funds will be held for you in a pending account. When you set up your account, the funds in the pending account are automatically transferred into your account.


SMS messages


Mobi Mani is not responsible for delays in sending/receiving sms.


Inbound SMS


You pay for all messages to Mobi Mani from your phone.


All sms messages sent to Mobi Mani must be in the correct format and must be in English.


All sms to Mobi Mani are sent to the same number.


Mobi Mani records all sms sent to and from the system.


Mobi Mani records the number of all sms sent to the system. Numbers that do not yet have accounts are recorded in a “Possible” file for marketing and promotional use.


Limiters


Mobi Mani sets limits the number of repeated sms it will respond to. If you exceed the limit for a feature, Mobi Mani will stop sending you replies to that feature for x days. The others features of your account will still work. An explanation of the limiters is included in Appendix C. The limiters and their inactivation periods can be change dat any time without notice. If Mobi Mani receives two identical sms from the same number in a ten-second interval, then Mobi Mani will process the first transaction and ignore the second transaction.


Outbound SMS


All Mobi Manisms originate from the same number.


Some Mobi Mani functions will not receive sms replies.


Mobi Mani reserves the right to charge a fee for sms sent from Mobi Mani.


Mobi Mani may, from time to time, send promotional sms to you to promote Mobi Mani or on behalf of advertisers who have engaged Mobi Mani to provide this service. Advertisers are never given access to your account information, nor are they given your mobile number.


Opt-in Features


Mobi Mani provides a number of optional features to enhance the security and ease-of-use of your account. Some of these features attract a fee and Mobi Mani reserves the right to change the fee without notice.


SMS confirmation


You can request that Mobi Mani send you an sms to confirm a transaction.


Secret Word


The secret word is required to suspend an account.


Change secret word


You can change their secret word.


Suspend account


You can suspend your account from any mobile phone. You must have a secret word.


Reinstate account


You can reinstate an account that has been suspended. Suspended accounts can only be reinstated from the phone number of the account.


Passcode


You can use a passcode to minimise the possibility of accidently sending funds to the wrong account. You can nominate a passcode for your account. Tell the passcode to any other user who wants to send you money, and have them include the passcode with the send money sms. Payment is only accepted if the passcode in the sms matches the passcode for the recipient account.


Language Option


You can choose to receive messages from Mobi Mani in English, French or Bislama.


Account balance


You can request an sms with the balance of your Mobi Mani account.


Transaction history


You can request a sms from Mobi Mani that contains four consecutive transactions. Transaction history does not reflect fees and charges incurred.


Agents and agent status


Mobi Mani may, at its sole discretion, grant agent status to an account. Agent status is granted to an account to assist in promoting Mobi Mani and getting money onto the system. Mobi Mani may revoke agent status at any time. Agent status benefits and requirements may change at any time.


Promotions


From time to time, Mobi Mani may offer promotional incentives to it users and/or potential users. Promotion are not retro-active. Fair use policies apply. A list of current promotions is in Appendix D.


Changes in terms of use


Mobi Mani reserves the right to change the terms of use, at any time without notification. Any change will be effective when they are communicated in any way. Your continued use of the Mobi Mani service means that you agree to the changes.


Delay or suspension of service.


Mobi Mani reserves the right to inactivate your account or delay the service if Mobi Mani feels that the account and/or service is being misused.


Without limiting any other provision of this agreement, if we or any other service provider reasonably believes that your conduct in using Mobi Mani constitutes a threatening condition (including but not limited to, violation of any part of this agreement, violation of any applicable laws, rules, regulations or industry standards), or otherwise poses a threat a threat to any system, equipment, process, intellectual property, or the reputation of us or any service provider, we may provide you with a notice to cease the threatening condition. If, in the reasonable and good faith determination of us or any service provider, the threatening condition poses and imminent or actual threat (including regulatory investigation, inquiry, or penalty) to us or any service provider or its systems, equipment, processes, or intellectual property, you agree that we may suspend or terminate any and all use of the system without notice.


Termination


Mobi Mani may terminate all or part of this agreement and your use of any or all of the Mobi Mani system for any reason and at any time with or without prior notice as the law requires.


Warranties


Neither Mobi Mani nor any service providers represents or warrants the accuracy, adequacy, completeness, or timeliness of any aspect of the Mobi Mani system. All aspects of the Mobi Mani system are provided As Is and As Available without warranty of any kind, either express or implied.


In the event of a system failure or interruption, your data may be lost or destroyed. Any transactions that you initiated or were in the process of completing should be verified by you to ensure the accuracy and completeness of those transactions. You assume the risk of loss of your data during any system failure or interruption and the responsibility to verify the accuracy and completeness of those transactions .


Indemnity


In no event will Mobi Mani or any of its agents, officers, directors, employees, consultants, other service providers, or licensors be liable under any contract, tort, negligence, strict liability or other claim for any direct, indirect, incidental, special, consequential, or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses (even if advised of the possibilities of such damages) whether caused by or resulting from (i) the use or the inability to use the Mobi Mani service, (ii) any failure of performance, error, omission, interruption, delay in operationor transmission, computer virus, lost of data, theft, destruction, or unauthorised access to your account information, (iii) errors, inaccuracies, omissions, or other defects in information or content provided by, or contained within, or obtained through the Mobi Mani service, or (iv) any other failure, action, or omission, and regardless of whether arising under breach of contract, tortious behaviour, negligence or under any other theory or cause of action.


You agree to indemnify, defend and hold Mobi Mani and its officers, agents, directors, employees, consultants, agents, other service providers and licensors harmless from any and all third party claims, actions, liability, damages and/or costs (including, but not limited to, reasonable attorney fees) arising from (a) a third party claim, action, or allegation of infringement, misuse, or misappropriation based on information, data, files, or other material submitted by you to or through the Mobi Mani service; (b) any fraud, manipulation or other breach of this agreement by you; (c) any third party claim, action or allegations brought against Mobi Mani arising out of or relating to a dispute with you over the terms and conditions of an agreement or related to the purchase or sale of any goods or services; (d) you violation of any law or rights of a third party; or the use of your account by any third party.


Waiver


We may waive any term or provision of this agreement at any time or form time to time. We will not be deemed to have waived any of our rights or remedies with regard to this agreement unless our waiver is in writing and signed by an authorised officer of Mobi Mani. No delay or omission on the part of Mobi Mani in exercising any rights or remedies will operate as a waiver of those rights or remedies or any other rights or remedies. A waiver on one occasion will not be construed as a bar or waiver of any rights or remedies on future occasions.


Severability; Headings


If any provision of this Agreement is held to be void or unenforceable in any jurisdiction, such ineffectiveness or unenforceability shall not affect the validity or enforceability of such provision in any other jurisdiction or any other provision in that or any other jurisdiction. The headings in this Agreement are for convenience or reference only and do not govern the interpretation of provisions of the Agreement.


Governing Law


This agreement is governed by all applicable laws of the Republic of Vanuatu.


Complete Agreement


This agreement represents the sole and exclusive agreement between you and Mobi Mani regarding the use of the Mobi Mani system and merges and supersedes all previous and contemporaneous written or oral agreements and understandings regarding the subject matter hereof.

Appendix B - Mobi Mani Thresholds


Thresholds are the total amount of money that a user can send in a given time period. If a transaction takes a user over the threshold, then that transaction will be cancelled.

Account Inactivation Duration -- 24 hours


Appendix C - Mobi Mani Limiters Limiters


Limiters limit the number of times a user can send the same type of sms to Mobi Mani before Mobi Mani stops sending a response. For instance, a user can only send the info text two times before Mobi Mani stops responding for 24 hours. The user will still be able to use other Mobi Mani features, just not the info feature.
